1. Acceptance of Terms

By using the Website or proceeding with any purchase or adoption process, you agree to these Terms. We reserve the right to modify these Terms at any time. Changes are effective upon posting to the Website. Your continued use after changes are posted constitutes acceptance of the new Terms.

2. License to Use Website

We grant you a limited, revocable, non-exclusive license to access and use the Website for personal, non-commercial purposes. You may not resell, distribute, or commercially exploit any content. We reserve the right to revoke access at our discretion.

3. Eligibility

You must be at least 18 years old and possess the legal capacity to enter into a binding contract to use this Website or adopt a kitten. We reserve the right to refuse service to anyone.

4. Monitoring and Accuracy

While we strive for accuracy, we do not warrant that all information on the Website is complete, reliable, or current. Information is subject to change without notice.

5. Third-Party Services

The Website may contain links to third-party services. We are not responsible for the content, accuracy, or practices of these third-party sites. Your use of such services is at your own risk.

6. Reservation and Payment Policy

6.1 Reservation Fee: A non-refundable reservation fee is required to secure a kitten. This fee covers administrative costs and preparation.
6.2 Payment: All payments must be made through our approved processors with accurate information.
6.3 Unauthorized Chargebacks: Chargebacks initiated without a legitimate basis are a material breach of this agreement and will result in legal action to recover losses, including fees and penalties.

7. Delivery and Shipping

7.1 Timing: Delivery occurs within 2-14 days after veterinary clearance. Delays due to health, weather, or logistics may occur and are not grounds for cancellation.
7.2 Customer Response: You must respond and arrange delivery within 7 days of being notified the kitten is ready. Failure to do so will result in a $25/day boarding fee. After 14 days, the reservation may be deemed abandoned, and all fees forfeited.
7.3 Refusal of Delivery: Refusing delivery based on appearance, origin, or non-health-related preference is a breach of contract and will result in forfeiture of all fees paid.

8. Customer Responsibilities

You are responsible for the kitten’s ongoing care, including proper nutrition, veterinary care, and a safe environment. You assume all risks inherent in pet ownership.

9. SMS Communication Policy

By providing your phone number, you consent to receive recurring SMS messages from us. Message frequency varies. Reply STOP to unsubscribe. Message and data rates may apply.

10. Rehoming and Right of First Refusal

If you can no longer care for the kitten, we retain the right of first refusal to repurchase it for $1. If we decline, you must provide us with the new owner’s contact information.

11. Limitation of Liability

To the fullest extent permitted by law, our liability shall not exceed the amount you paid for the kitten. We are not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify and hold harmless Purebred LLC, its affiliates, and agents from any claims arising from your use of the Website, violation of these Terms, or ownership of the kitten.

13. Termination

We may terminate your access to the Website or cancel an adoption at our sole discretion for any breach of these Terms.

14. Entire Agreement

These Terms constitute the entire agreement between you and Purebred LLC and supersede all prior communications and agreements.

15. Force Majeure

We are not liable for delays or failures in performance resulting from acts beyond our reasonable control, including natural disasters, war, or acts of God.

16. No Warranties Disclaimer

We make no warranties regarding the kitten’s future health, behavior, size, coat quality, or temperament.

17. Assumption of Risk

You acknowledge that adopting a live animal involves inherent unpredictability, and you assume all risks related to the kitten’s health, behavior, and adjustment.

18. Time Limit for Disputes

Any claim or dispute related to the adoption must be initiated within six (6) months from the date of delivery. Claims filed after this period are permanently barred.

19. Right to Refuse or Cancel Adoption

We reserve the right to refuse or cancel any adoption for reasons including, but not limited to, buyer misconduct, failure to provide information, or concerns for the kitten’s welfare. Fees are forfeited if cancellation is due to buyer abandonment or breach.

20. Jurisdiction and Venue

These Terms are governed by the laws of the State of Delaware. Any legal action shall be filed in the state or federal courts located in Delaware.

21. No Third-Party Reliance

Only written statements issued by Purebred LLC are binding. Verbal statements or opinions from third parties are not part of this agreement.

22. Rehoming Responsibility

If you must rehome the kitten, you assume full responsibility for finding a safe and appropriate home. We are not obligated to assist in rehoming.

23. Customer Acknowledgment

You understand that live animals may experience minor health fluctuations. The reservation fee is non-refundable.

24. Customer Confirmation

By submitting payment, you confirm you have read these Terms, acknowledge the non-refundable nature of the reservation fee, and accept the kitten’s condition.

25. Exclusive Remedy Clause

The remedies outlined in these Terms are your exclusive remedies. No other remedies apply.

26. Limitation on Damages

In no event shall our liability exceed the purchase price of the kitten. Emotional distress or loss of companionship is not compensable.

27. Ready-For-Travel Kittens Notice

A “Ready-for-Travel” label means the kitten is weaned and medically cleared. Final release may still be postponed for veterinary, weather, or logistical reasons.

28. Age Disclosure and Development

Kittens are adopted at a healthy age, typically 16 weeks or older. Development and readiness may vary by breed.

29. Liquidated Damages for Contract Violation

Public defamation, false online reviews, or social media disparagement may cause irreparable harm. You agree that liquidated damages of $2,500 per violation are a reasonable estimate of the harm caused.

30. Sales Limitations

We reserve the right to limit or restrict sales to certain individuals, households, or regions at our sole discretion.

31. Client Response Timeline

You must finalize delivery arrangements within 7 days of notification. Failure to respond within 14 days will result in the reservation being deemed abandoned, with all fees forfeited.

32. Website Errors & Accuracy Disclaimer

We are not responsible for typographical, pricing, or photographic errors and reserve the right to correct such errors.

33. Prohibited Use

You may not use the Website for any unlawful purpose, including spamming, phishing, or transmitting malicious code. We may terminate access for any prohibited use.

34. Optional Tools & Third-Party Integrations

Third-party tools are provided “as is.” We are not liable for their functionality, availability, or performance.

35. Feedback, User Submissions & Media Consent

By submitting feedback or media, you grant us a perpetual license to use it for promotional purposes. You consent to the use of photos/videos from the adoption process in our marketing.
